Dairying

There are a variety of standard clauses which are inserted into agreements for sale and purchase of dairy farms. These clauses relate to autumn saved pasture and the amount of cover to be left on the farm. This can often be measured in dry matter per hectare and a range of between 1,800 and 2,200 is common. Arbitration provisions can be used should there be any disagreement about the cover.

Fertiliser application is usually stipulated, with receipts being provided.

Every year new share clauses are provided as the share structure of various companies have changed. These clauses tend to be very specific and care needs to be taken to ensure that what is being bought and sold is what is expected.

Resource consents for effluent disposal and the right to take water in specific areas are essential. It has become common for there to be clauses about dairy plant, shed and tanker tracks meeting the requirements of the dairy company and/or MAF. Depending on the location of the farm, there may be a requirement for drains to be cleaned or hedges to be cut and other remedial work to be undertaken.
